Terms & Conditions

1. Contract
All orders are accepted on the terms and conditions contained herein unless these terms are varied in writing by an authorised officer of IPM Ltd.

2. Orders
The contract to supply is between Avian Control Systems /IPM Ltd and the private individual or Company placing the order. Avian Control Systems Ltd / IPM Ltd  reserves the right to refuse to accept the Purchasers order. No order is valid until the Company issues a printed acknowledgement.

3. Payment Terms
Strictly cash with order. No goods will be sent out until cash received or credit / debit card details accepted or cheques cleared. When the Purchaser is paying by credit card, payment is taken on the day the goods are shipped.

4. Prices
All prices quoted are in pounds sterling and are exclusive of Value Added Tax (VAT) and carriage, where this is applicable.

5. Re-Presented Cheques
A £30.00 charge will be made each time a cheque has to be re-presented for clearance.

6. Price Changes
Prices quoted are subject to change without notice, though Avian Control Systems Ltd  will try, wherever possible, to give notice of any changes. These normally occur on an annual basis, but can happen at any time if our costs change significantly.

7. Carriage Charges – UK Mainland
Our standard 2-3 day delivery charges are £4.99 + VAT. Orders over £60 exc VAT are shipped free of charge. For orders under £10, delivery charges are £2.99 + VAT.

8. Special Deliveries (includes timed deliveries and weekend deliveries)
Please call our customer service team on 01992 763 776 to arrange special deliveries. All special deliveries will incur a carriage charge regardless of value.

9. Carriage Charges – Scottish highlands and islands, Northern Ireland, Channel Islands, Isle of Man and Eire
Orders to here are chraged at a cost of £25.99 + VAT per order.  Orders over £200 exc VAT are shipped free of charge.

10. Delivery Address
Deliveries can only be made to a full postal address, which has a complete Postal Code. If an order cannot be signed for at the time of delivery then a delivery card will be left stating that a delivery was attempted and another attempt will be made the following day.

11. Deliveries to Site
All deliveries to site (any address other than the customer’s normal address) will be handled on the same terms as described above.

12. Failure to Deliver or Failure to Deliver on Time
The Company can accept no responsibility whatsoever for circumstances arising from the failure of the carrier to deliver goods or to deliver by an agreed time. Where it can be proved that the carrier was at fault, the only compensation that can be paid will be the costs of the carriage.

IF THE GOODS ARE NEEDED BY A SPECIFIC DATE OR TIME, PLEASE ENSURE THAT ITEMS  ARE ORDERED IN GOOD TIME.

13. Goods Out Of Stock
We aim to hold sufficient stock of all our product lines offered on this website to meet client demand for next day delivery. However, if we are out of stock of any item, this will normally be pointed out to you on receipt of your order and special arrangements made to meet your requirements (i.e. dispatch direct to you from the manufacturer)

14. Return Of Goods
Goods supplied against a firm order may not be returned without the Purchaser applying for, and receiving, the consent of the Company. Goods will not normally be accepted for return after 14 days from the delivery date with no return for orders under £50.00 excluding carriage. Goods for return must be in a saleable condition including the product packaging they arrived in, and will be subjected to a 30% handling charge unless the goods were delivered in error by the Company. No credit will be given until we receive the returned goods back at our warehouse.

15. Notification Of Damaged Goods
All deliveries must be inspected for visible damage prior to acceptance. Any damage must be noted on the documentation held by the Carrier. All deliveries should be unpacked as soon as possible, and any concealed damage must be reported. Notify Avian Control Systems Ltd immediately any damage is confirmed, and full arrangements to rectify the problem will be made. This notification must be received WITHIN 3 DAYS OF RECEIPT OF GOODS and confirmed in writing or the claim may be repudiated by the carrier.

16. Non- Delivery
We must be notified of non-delivery WITHIN 3 DAYS OF YOUR RECEIVING THE INVOICE and confirmed in writing, or the claim may be repudiated by the carrier.

17. Title to The Goods
All goods remain the property of Avian Control Systems / IPM Ltd until paid for in full, governed exclusively by the Laws of England

18. Warranty
All goods supplied by the Company carry the manufacturers warranty, and it is the responsibility of the Buyer to register the warranty and ensure that it is not invalidated in any way.

19. Installation
The Company can quote to install it’s products if requested to do so. Products should only be installed using the materials and methods recommended by Avian Control Systems Ltd. The use of other materials and methods will invalidate the product warranty.

20. Change In Product Specification
The Company works closely with its suppliers on continuing product enhancements and development. Avian Control Systems Ltd reserve the right to modify the specification of products on sale without prior notification.

21. Errors & Omissions
Any errors contained in the Company's website price list, acknowledgement or
invoice shall be rectified by the Company when discovered, and notified to the Buyer. Buyer and Company shall have the option to settle any outstanding amounts or cancel the order.

22. Patents & Copyright
Many of the products in this price list are protected by patents or design copyrights. All information may only be reproduced with the written permission of Avian Control Systems / IPM Ltd.

23. Liability
Avian Control Systems / IPM Ltd accepts no liability for matters arising from, or contributed to by, the installation of it’s products by the customer or the customer’s contractors.
